PRX Vault Gift Card Terms and Conditions

These Gift Card Terms and Conditions ("Gift Card Terms") govern the purchase, delivery, and redemption of gift cards made available through the PRX Vault Platform, operated by PRX Enterprises Pty Ltd (ACN 682 267 769) ("we", "us", "our"). These Gift Card Terms form part of, and should be read together with, the PRX Vault Terms of Use and Privacy Policy available at prxvault.com.

By purchasing or redeeming a gift card through the PRX Vault Platform, you agree to be bound by these Gift Card Terms. If you do not agree, you must not purchase or use a gift card through the Platform.

Important: Gift card purchases are final and non-refundable. All sales are subject to the terms set out below. Please read these Gift Card Terms carefully before completing your purchase.

Section 1

Definitions

In these Gift Card Terms:

  • "Gift Card" means a digital gift card made available for purchase through the PRX Vault Platform, including both PRX Vault-Issued Gift Cards and Third-Party Gift Cards.
  • "PRX Vault-Issued Gift Card" means a gift card issued directly by PRX Enterprises Pty Ltd and redeemable on the PRX Vault Platform.
  • "Third-Party Gift Card" means a gift card issued by a third-party retailer or brand ("Issuer") and made available for purchase through the PRX Vault Platform.
  • "Purchaser" means the person who purchases a Gift Card through the Platform.
  • "Recipient" means the person to whom a Gift Card is delivered or gifted.
  • "Gift Card Value" means the monetary value loaded onto a Gift Card at the time of purchase.
  • "Expiry Date" means the date that is 3 years from the date of purchase of the Gift Card, as displayed in the Gift Card email or on the Platform.
  • "Platform" means the PRX Vault website at www.prxvault.com and associated mobile application.

Section 2

Types of Gift Cards

PRX Vault-Issued Gift Cards

PRX Vault-Issued Gift Cards are issued by PRX Enterprises Pty Ltd and are redeemable for eligible purchases made through the PRX Vault Platform. The terms in this document apply in full to PRX Vault-Issued Gift Cards. PRX Enterprises Pty Ltd is the Issuer and is responsible for all obligations in connection with PRX Vault-Issued Gift Cards.

Third-Party Gift Cards

Third-Party Gift Cards are issued by independent retailers and brands. PRX Vault acts as a reseller and distribution intermediary only. By purchasing a Third-Party Gift Card, you acknowledge that:

  • the Third-Party Gift Card is issued by the named Issuer, not by PRX Vault;
  • the redemption, use, and validity of a Third-Party Gift Card is governed by the Issuer's own terms and conditions, which will be provided or linked at the time of purchase;
  • PRX Vault is not responsible for the Issuer's products, services, availability, or any failure to honour the Third-Party Gift Card; and
  • any dispute relating to the redemption or use of a Third-Party Gift Card must be directed to the relevant Issuer.

Section 3

Purchasing Gift Cards

Eligibility

To purchase a Gift Card through the Platform, you must:

  • hold an active PRX Vault account in good standing;
  • be at least 18 years of age; and
  • be an Australian resident or otherwise legally entitled to make the purchase.

Payment

Gift Cards may only be purchased using a valid credit or debit card accepted by the Platform. Payment is processed securely through our third-party payment processor. By completing a purchase, you represent that you are the authorised holder of the payment method used.

The full Gift Card Value is charged at the time of purchase. Prices displayed on the Platform are in Australian dollars (AUD) and are inclusive of any applicable GST.

Purchase Limits

We reserve the right to impose limits on the number or total value of Gift Cards that may be purchased by a single user in a given period. Any such limits will be displayed on the Platform. We may decline a purchase or cancel an order where we have reason to suspect fraud, abuse, or a breach of these Gift Card Terms.

Order Confirmation

Upon successful payment, you will receive an order confirmation by email to the address registered to your PRX Vault account. This confirmation constitutes our acceptance of your order. We reserve the right to cancel an order prior to delivery of the Gift Card where payment is not successfully processed or where we have reason to suspect fraudulent activity, in which case a full refund will be issued to your original payment method.

Section 4

Delivery

Digital Delivery

All Gift Cards are delivered digitally by email. Upon successful purchase, the Gift Card (including its unique code and any applicable terms) will be sent to the email address you specify at the time of purchase. Delivery is typically within 24 hours of purchase confirmation, but may be subject to processing delays.

Delivery Failure

It is your responsibility to provide a valid and accurate email address at the time of purchase. We are not responsible for non-delivery of a Gift Card resulting from an incorrect or inactive email address, spam or junk mail filters, or other factors outside our control.

If you do not receive your Gift Card within 48 hours of purchase, please contact us at support@prxvault.com.au with your order confirmation number. We will make reasonable efforts to resend the Gift Card, provided we are satisfied the original has not been accessed or redeemed.

Risk of Loss

Risk of loss of, or access to, a Gift Card passes to the Purchaser upon delivery of the Gift Card email to the specified email address. We strongly recommend that you store your Gift Card code securely and do not share it with others.

Section 5

Redemption

PRX Vault-Issued Gift Cards

PRX Vault-Issued Gift Cards may be redeemed for eligible purchases on the PRX Vault Platform by entering the unique Gift Card code at checkout. The Gift Card Value will be applied to your purchase up to the available balance. Where the purchase price exceeds the Gift Card Value, the remaining amount must be paid using another accepted payment method.

PRX Vault-Issued Gift Cards:

  • may only be redeemed on the PRX Vault Platform;
  • cannot be used to purchase other gift cards;
  • cannot be redeemed for cash, transferred to a bank account, or exchanged for cashback; and
  • may not be combined with certain promotional offers, as specified at the time of redemption.

Third-Party Gift Cards

Third-Party Gift Cards are redeemed directly with the relevant Issuer in accordance with the Issuer's redemption terms. PRX Vault has no involvement in or responsibility for the redemption process for Third-Party Gift Cards. Please refer to the Issuer's terms and conditions provided at the time of purchase.

Partial Redemption and Balance

For PRX Vault-Issued Gift Cards, any unredeemed balance remaining after a transaction will be retained on the Gift Card and may be used in future transactions on the Platform, subject to the Expiry Date. You can check your Gift Card balance on the Platform.

Section 6

Expiry

All Gift Cards have an Expiry Date of 3 years from the date of purchase. The Expiry Date is displayed in the Gift Card email and on the Platform. Any unredeemed Gift Card Value remaining after the Expiry Date will be forfeited and cannot be recovered, refunded, or extended.

For Third-Party Gift Cards, the expiry terms set by the relevant Issuer apply and may differ from the above. Please review the Issuer's terms carefully.

Australian Consumer Law note: For PRX Vault-Issued Gift Cards, we comply with the gift card provisions of the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), which require that gift cards have a minimum expiry period of 3 years and that the expiry date be clearly displayed. Post-supply fees that reduce the redeemable value of a gift card before its expiry are prohibited.

Section 7

Fees

For PRX Vault-Issued Gift Cards, we do not charge any activation, maintenance, administration, or inactivity fees that reduce the redeemable value of a Gift Card before its Expiry Date, in accordance with the Australian Consumer Law.

The purchase price for a Gift Card equals its face value (Gift Card Value) unless otherwise stated on the Platform at the time of purchase. We may offer Gift Cards at a discount as part of promotional activities; any such promotions are subject to separate terms.

Third-Party Gift Cards may be subject to fees imposed by the Issuer. Please review the Issuer's terms and conditions before purchase.

Section 8

No Refunds

All Gift Card purchases are final. We do not offer refunds, exchanges, or cancellations on Gift Cards once purchased, except:

  • where we have cancelled your order prior to delivery (see clause 3.4); or
  • where we are required to provide a remedy under the Australian Consumer Law, including where a Gift Card is subject to a major failure (for example, we fail to deliver a valid and functional Gift Card code).

If you believe you are entitled to a remedy under the Australian Consumer Law, please contact us at support@prxvault.com.au with your order details. We will assess each claim on a case-by-case basis.

This no-refund policy applies regardless of whether the Gift Card has been used, partially used, or remains unredeemed. We strongly recommend that you confirm all purchase details before completing your transaction.

Section 9

Lost, Stolen, or Compromised Gift Cards

Gift Cards are treated like cash. We are not responsible for any loss, theft, or unauthorised use of a Gift Card or its unique code after delivery to the specified email address. We will not replace a Gift Card that has been lost, stolen, disclosed to a third party, or redeemed by an unauthorised person, except where we are required to do so under the Australian Consumer Law.

If you suspect that your Gift Card code has been compromised or used without authorisation, please contact us immediately at support@prxvault.com.au. We will investigate and take reasonable steps to assist, but cannot guarantee recovery of any redeemed value.

Section 10

Fraud and Prohibited Use

You must not purchase, use, or attempt to use a Gift Card:

  • for any unlawful purpose, including money laundering or fraud;
  • to circumvent any security, fraud prevention, or verification measure on the Platform;
  • using stolen, fraudulent, or unauthorised payment methods;
  • in connection with the purchase of other gift cards on the Platform (card-on-card stacking); or
  • in any manner that violates these Gift Card Terms or the PRX Vault Terms of Use.

We reserve the right to cancel, suspend, or void any Gift Card where we have reasonable grounds to suspect fraudulent activity or a breach of these Gift Card Terms. In such cases, no refund will be issued. We may also report suspected fraud to relevant law enforcement authorities.

Section 11

GST and Taxes

Gift Card prices are displayed in AUD inclusive of GST where applicable. The purchase of a Gift Card may not itself attract GST; however, GST may apply at the point of redemption depending on the goods or services acquired. You are responsible for any tax obligations arising from your purchase or use of a Gift Card. We recommend seeking independent tax advice if required.

Section 12

Australian Consumer Law

Nothing in these Gift Card Terms excludes, restricts, or modifies any right, guarantee, warranty, or remedy available to you under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable legislation that cannot lawfully be excluded. Where the Australian Consumer Law applies, our liability is limited to the extent permitted by law, including by resupply of the relevant gift card or refund of the purchase price.

For PRX Vault-Issued Gift Cards, we comply with Division 2 of Part 3-1 of the Australian Consumer Law relating to gift cards, including the requirements that:

  • gift cards have a minimum expiry period of 3 years from the date of supply;
  • the expiry date is clearly disclosed at the time of supply; and
  • no post-supply fees are charged that reduce the redeemable value of the gift card prior to expiry.

Section 13

Limitation of Liability

To the maximum extent permitted by Australian law, our total liability to you in connection with a Gift Card (whether in contract, tort, statute, or otherwise) is limited to the Gift Card Value of the relevant Gift Card.

To the maximum extent permitted by law, we exclude all liability for:

  • indirect, incidental, consequential, or punitive damages arising from your purchase or use of a Gift Card;
  • any failure by a Third-Party Issuer to honour or accept a Third-Party Gift Card;
  • loss or damage resulting from unauthorised access to or use of a Gift Card code after delivery; and
  • any interruption or error in the Platform affecting Gift Card purchases or redemptions.

Section 14

Changes to These Gift Card Terms

We may update these Gift Card Terms from time to time. Any changes will be published on the Platform with an updated effective date. Changes will not apply retrospectively to Gift Cards purchased before the effective date of the updated terms. Your continued use of the Platform following notification of changes constitutes your acceptance of the updated Gift Card Terms.

Section 15

Governing Law

These Gift Card Terms are governed by the laws of Queensland, Australia. Any dispute arising in connection with these Gift Card Terms will be subject to the exclusive jurisdiction of the courts of Queensland, Australia
